Penbroke Terms of Use

These Terms of Use govern your access to and use of the Penbroke mobile application, Penbroke-related webpages, and associated services.

Penbroke is operated by The Curving Point Ltd. References to “Penbroke,” “we,” “us,” or “our” mean The Curving Point Ltd.

By creating an account, accessing Penbroke, or using any Penbroke feature, you agree to these Terms of Use and acknowledge our Privacy Policy, Community Guidelines, and Copyright and Sharing Policy.

Do not use Penbroke if you do not agree to these Terms.

1. About Penbroke

Penbroke is a literary reading, reflection, and community platform.

Features may include:

  • Original books and serialized stories
  • Reading progress and bookmarks
  • Highlights, underlines, pins, and notes
  • Private journal entries
  • Offline chapter downloads
  • Search and reading customisation tools
  • Quotations shared through Penbroke’s sharing features
  • Community questions, responses, comments, replies, and reactions
  • Anonymous posting options where available

Features may change, be added, restricted, suspended, or removed as Penbroke develops.

2. Eligibility

You must be at least 13 years old to create a Penbroke account.

If you are under the age of legal majority where you live, you may use Penbroke only with the permission and supervision of a parent or legal guardian.

By using Penbroke, you represent that:

  • You meet the applicable age requirements
  • You have the legal ability to agree to these Terms
  • The information you provide is accurate
  • You are not prohibited from using Penbroke under applicable law
  • Any parent or guardian whose permission is required has reviewed and agreed to these Terms

Parents and guardians are responsible for supervising minors’ use of Penbroke, particularly community and sharing features.

3. Your Account

Certain Penbroke features require an account.

You agree to:

  • Provide accurate and current account information
  • Maintain the confidentiality of your login credentials
  • Keep your email address accessible and updated
  • Notify us promptly if you suspect unauthorised access
  • Accept responsibility for activity conducted through your account

You may not:

  • Create an account using another person’s identity
  • Impersonate another person, organisation, author, moderator, or representative of Penbroke
  • Share, sell, transfer, or commercially rent your account
  • Create accounts to evade a suspension, restriction, or ban
  • Use automated methods to create or control accounts
  • Attempt to access another person’s account

We may require account verification or additional information when reasonably necessary for security, moderation, support, or legal compliance.

4. Limited Licence to Use Penbroke

Subject to these Terms, The Curving Point Ltd. grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-commercial licence to access and use Penbroke on a compatible device.

Penbroke and its content are licensed for personal use and are not sold to you.

You may not:

  • Copy, reproduce, republish, distribute, sell, or commercially exploit Penbroke or its content except through authorised features
  • Remove copyright, trademark, authorship, or ownership notices
  • Reverse engineer, decompile, disassemble, or attempt to extract Penbroke’s source code, except where applicable law expressly permits it
  • Circumvent access controls, security features, sharing limits, release schedules, or content restrictions
  • Scrape, crawl, index, harvest, or automatically extract books, chapters, community content, or user information
  • Upload malicious code or interfere with Penbroke’s operation
  • Use Penbroke to develop or train an artificial-intelligence system without prior written permission
  • Use Penbroke or its content for commercial publication, resale, or unauthorised distribution

All rights not expressly granted are reserved by The Curving Point Ltd. and the applicable content owners.

5. Books, Chapters, and Content Availability

Books and chapters may be released gradually or made available for limited periods.

We do not guarantee that:

  • Every book or chapter will remain available indefinitely
  • Release dates will never change
  • Every feature will be available on every device
  • Downloaded content will remain accessible after an account, licence, app version, or service change
  • Penbroke will always operate without interruption

We may correct, revise, replace, delay, suspend, or remove content where reasonably necessary.

Offline downloads are provided for personal reading within Penbroke. Downloading a chapter does not transfer ownership of the chapter or give you permission to distribute it outside the app.

6. Your Notes and Private Reading Content

Penbroke may allow you to create:

  • Highlights
  • Underlines
  • Pins
  • Bookmarks
  • Private notes
  • Journal entries
  • Reading preferences and progress records

You remain responsible for content you create.

Although notes and journal entries may be designated private, you should not use Penbroke as the sole storage location for information that is highly sensitive, irreplaceable, or required for legal, medical, financial, or professional purposes.

We cannot guarantee that information will never be lost because of device failure, software errors, account deletion, service interruption, or other technical events.

7. Community Content

“Community Content” includes questions, responses, comments, replies, reactions, profile information, reports, and other material submitted through Penbroke’s community features.

You retain ownership of original Community Content you create.

By posting Community Content, you grant The Curving Point Ltd. a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display, distribute, and otherwise use that content only as reasonably necessary to:

  • Operate Penbroke
  • Display the content to users
  • Provide community features
  • Moderate and review content
  • Investigate reports
  • Enforce these Terms and our policies
  • Maintain backups and security
  • Promote Penbroke using a contribution only where appropriate and lawful

This licence ends when your content is deleted from active systems, except where continued retention is reasonably necessary for backups, security, legal compliance, moderation records, dispute resolution, or protection against abuse.

You represent that:

  • You created the content or have permission to post it
  • Posting it does not violate another person’s rights
  • It is not confidential information belonging to another person
  • It complies with these Terms and the Community Guidelines

8. Anonymous Contributions

Where Penbroke offers anonymous posting, your profile name and photograph will not be displayed publicly with that contribution.

Anonymous posting does not mean that the contribution is technically unconnected to your account.

Penbroke may retain an internal connection between an anonymous contribution and the account that submitted it for:

  • Moderation
  • Security
  • Abuse prevention
  • Report investigation
  • Enforcement
  • Legal compliance

You may not use anonymous posting to harass others, evade responsibility, manipulate discussions, impersonate another person, or violate these Terms.

9. Prohibited Conduct

Penbroke does not tolerate objectionable content or abusive users.

You may not post, transmit, promote, encourage, or engage in content or conduct that:

  • Threatens, harasses, bullies, intimidates, stalks, or targets another person
  • Promotes hatred, discrimination, or dehumanisation
  • Contains unlawful sexual content or sexual exploitation
  • Sexualises or exploits minors
  • Encourages self-harm, violence, terrorism, or criminal conduct
  • Reveals another person’s private or identifying information without permission
  • Contains spam, scams, fraud, deceptive promotions, or malicious links
  • Infringes copyright, trademark, privacy, publicity, or other rights
  • Impersonates another person or falsely represents an affiliation
  • Attempts to manipulate likes, reports, responses, or community activity
  • Disrupts discussions through repeated, irrelevant, or abusive posts
  • Uses bots, automated tools, or scripts without written authorisation
  • Attempts to evade moderation, blocking, suspension, or account restrictions
  • Interferes with Penbroke’s security or operation
  • Violates applicable law
  • Violates our Community Guidelines or other published policies

Context, educational purpose, literary discussion, and good-faith disagreement may be considered during moderation, but they do not excuse harassment, threats, exploitation, or unlawful conduct.

10. Reporting, Blocking, and Moderation

Penbroke may provide tools to:

  • Report content
  • Report users
  • Block users
  • Remove or hide your own contributions
  • Request assistance from moderators

Reports should be made honestly and should not be used to harass, retaliate against, or silence another user merely because of disagreement.

When reviewing content, we may consider:

  • The content itself
  • The surrounding discussion
  • Relevant account history
  • Prior reports or warnings
  • The seriousness and frequency of the conduct
  • Safety, legal, and community risks

We may take action including:

  • Removing or limiting content
  • Hiding content while it is reviewed
  • Issuing a warning
  • Restricting posting or interaction features
  • Suspending an account
  • Permanently terminating an account
  • Preserving relevant records
  • Referring a matter to law enforcement or another authority when appropriate

We are not required to disclose confidential moderation methods, the identity of a reporting user, internal evidence, or security information.

Blocking a user may limit applicable interactions, but it may not remove every prior contribution or prevent all indirect references.

11. Intellectual Property

Penbroke, including its software, design, branding, logos, interfaces, original books, chapters, illustrations, graphics, editorial materials, and other content, is protected by copyright, trademark, and other intellectual-property laws.

Unless expressly stated otherwise, Penbroke content is owned by or licensed to The Curving Point Ltd.

“Penbroke,” The Curving Point name and branding, and associated marks may not be used without prior written permission.

Nothing in these Terms transfers ownership of Penbroke content or intellectual property to you.

12. Quotations and Sharing

Penbroke may allow you to share short quotations using authorised text or image-sharing tools.

Sharing permission is limited to:

  • Short excerpts
  • Personal, non-commercial sharing
  • Use of the authorised Penbroke sharing feature
  • Inclusion of the book title, chapter, author, Penbroke attribution, or other attribution supplied by the app
  • Compliance with any character, formatting, or technical limits imposed by Penbroke

You may not:

  • Share full chapters or substantial portions of a book
  • Combine multiple excerpts to reproduce a substantial part of a work
  • Remove or obscure required attribution
  • Present an author’s words as your own
  • Sell shared quotation images or use them in commercial merchandise
  • Use excerpts in advertising, paid publications, or commercial campaigns without written permission
  • Use screenshots or other methods to circumvent sharing limits

13. Copyright Complaints

We respect intellectual-property rights.

A copyright owner or authorised representative may contact us regarding material believed to infringe copyright.

A notice should include:

  • Identification of the copyrighted work
  • Identification of the material believed to be infringing
  • Information reasonably sufficient to locate the material
  • The complainant’s name and contact information
  • A statement explaining the basis of the complaint
  • Confirmation that the information supplied is accurate
  • Confirmation that the complainant is the owner or is authorised to act for the owner

We may remove or restrict disputed material while reviewing a complaint and may terminate repeat infringers where appropriate.

14. Purchases and Subscriptions

Penbroke may offer paid books, subscriptions, premium features, or other digital content in the future.

Before completing a purchase, applicable pricing, billing frequency, renewal terms, and cancellation information will be displayed.

Purchases made through Apple’s App Store or Google Play are also governed by the applicable store’s payment and refund rules.

Unless required by law or the applicable marketplace’s rules:

  • Completed digital purchases may be non-refundable
  • Subscriptions may renew automatically until cancelled
  • Deleting Penbroke does not automatically cancel an active subscription
  • Account deletion may affect access to previously purchased or subscribed content

Penbroke will not charge you without displaying the applicable purchase information and obtaining the required authorisation.

15. Third-Party Services

Penbroke may rely on third-party services for authentication, hosting, storage, app distribution, analytics, diagnostics, email, and other operational functions.

Your use of third-party services may also be governed by their terms and privacy policies.

We are not responsible for independent websites, platforms, or services that we do not control.

16. Privacy

Our collection and use of personal information are described in the Penbroke Privacy Policy.

By using Penbroke, you acknowledge that information may be processed as described in that policy.

Do not submit another person’s personal information unless you have permission and a lawful reason to do so.

17. Account Deletion

You may initiate account deletion within Penbroke through:

Profile → Account Settings → Delete Account

You may also follow the instructions on the Delete Your Penbroke Account webpage or contact us from the email address associated with your account.

Account deletion may permanently remove your profile, synced reading information, notes, journal entries, bookmarks, and other account data.

Some information may be retained where reasonably necessary for:

  • Legal compliance
  • Fraud or abuse prevention
  • Security
  • Dispute resolution
  • Moderation and enforcement records
  • Protection of Penbroke and its users

Deleting the Penbroke application from your device does not automatically delete your account.

Apple requires apps that support account creation to let users initiate account deletion from inside the app.

18. Suspension and Termination

You may stop using Penbroke at any time.

We may restrict, suspend, or terminate your access when we reasonably believe that:

  • You violated these Terms or another Penbroke policy
  • Your conduct creates a safety, legal, security, or operational risk
  • Your account is being used fraudulently or without authorisation
  • Suspension is required by law or a valid legal request
  • Continued service is no longer reasonably possible

Serious violations may result in immediate termination without a prior warning.

Termination does not remove obligations or liabilities that arose before termination.

Sections concerning intellectual property, user-content licences, disclaimers, liability, dispute resolution, and other provisions intended to survive will continue after termination.

19. Service Changes and Availability

Penbroke may be updated, modified, interrupted, or discontinued.

We may:

  • Add or remove features
  • Change supported devices or operating systems
  • Update release schedules
  • Perform maintenance
  • Restrict access during security incidents
  • Remove material that creates legal or safety concerns
  • Discontinue part or all of the service

Where reasonably practical, we may provide notice of material service changes.

20. Disclaimer of Warranties

To the fullest extent permitted by law, Penbroke is provided on an “as is” and “as available” basis.

We do not guarantee that:

  • Penbroke will always be uninterrupted, secure, or error-free
  • Every error or defect will be corrected
  • Content will always remain available
  • Reading progress or locally stored information will never be lost
  • Community content will always be accurate, appropriate, or reliable
  • Penbroke will meet every individual requirement

Literary, devotional, reflective, educational, or community content provided through Penbroke is not a substitute for professional medical, mental-health, legal, financial, or other specialised advice.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

21. Limitation of Liability

To the fullest extent permitted by applicable law, The Curving Point Ltd. and its officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to Penbroke.

This may include loss of data, loss of access, lost profits, reputational harm, or damages resulting from community content, service interruptions, unauthorised access, or reliance on content.

Where liability cannot legally be excluded, it will be limited to the extent permitted by applicable law.

Nothing in these Terms limits liability that cannot lawfully be limited, including liability arising from fraud or other conduct for which limitation is prohibited.

22. Your Responsibility for Violations

You are responsible for losses, claims, or expenses caused by your unlawful conduct, your infringement of another person’s rights, or your material violation of these Terms.

We reserve the right to control the defence of a claim involving Penbroke, subject to applicable law.

23. Changes to These Terms

We may update these Terms when Penbroke’s features, policies, legal obligations, or business practices change.

The updated version will be posted with a revised effective date.

For material changes, we may provide notice through Penbroke, the website, email, or another appropriate method.

Your continued use of Penbroke after updated Terms take effect constitutes acceptance of the revised Terms, except where applicable law requires additional consent.

24. Governing Law

These Terms are governed by the laws applicable to the jurisdiction in which The Curving Point Ltd. is legally established, without improperly limiting any mandatory consumer protections available where you live.

Any dispute should first be submitted to us in writing so that the parties may attempt to resolve it informally.

Nothing in these Terms prevents either party from exercising rights that cannot legally be waived or from seeking urgent relief where appropriate.

25. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

The invalid provision will be interpreted or limited only to the extent necessary to make it enforceable where permitted.

26. Entire Agreement

These Terms, together with the Privacy Policy, Community Guidelines, Copyright and Sharing Policy, and any purchase-specific terms, form the agreement between you and The Curving Point Ltd. regarding Penbroke.

If purchase-specific terms conflict with these Terms, the purchase-specific terms control only for that purchase.
