This Policy forms part of the Penbroke Terms of Use. By accessing, reading, downloading, posting, or sharing content through Penbroke, you agree to comply with this Policy.

1. Ownership of Penbroke Content

Unless otherwise stated, Penbroke and the materials made available through it are owned by, commissioned by, or licensed to The Curving Point Ltd.

Protected materials may include:

  • Books
  • Chapters
  • Stories
  • Titles
  • Character descriptions
  • Editorial material
  • Devotional or reflective content
  • Cover artwork
  • Illustrations
  • Photography
  • Logos
  • Icons
  • Page designs
  • Quote-card designs
  • App interfaces
  • Graphics
  • Audio or video material
  • Promotional copy
  • Software and source code
  • Other original creative material

Copyright and other intellectual-property rights remain with The Curving Point Ltd., the relevant author, artist, photographer, publisher, or other rights holder.

Access to Penbroke does not transfer ownership of any book, chapter, image, design, or other protected work to you.

2. Personal Reading Licence

Subject to the Penbroke Terms of Use, you receive a limited, personal, revocable, non-exclusive, non-transferable, and non-commercial licence to access and read content made available to you through Penbroke.

This licence allows you to:

  • Read available content inside Penbroke
  • Download eligible chapters for offline reading inside the app
  • Save bookmarks and reading progress
  • Create private highlights, underlines, pins, notes, and journal entries
  • Use Penbroke’s authorised sharing tools as described in this Policy

This licence does not permit you to reproduce, publish, sell, distribute, license, or commercially exploit Penbroke content.

3. Offline Downloads

Offline chapter downloads are provided for personal reading within Penbroke.

Downloading a chapter does not:

  • Transfer ownership of the chapter
  • Create a permanent copy for unrestricted use
  • Permit distribution outside Penbroke
  • Permit conversion into another file format
  • Permit uploading to another website, application, device library, or file-sharing platform
  • Permit removal of access controls or copyright notices

Offline content may become unavailable following account deletion, app removal, expiry of access, changes to a licence, or changes to Penbroke’s services.

4. Authorised Quotation Sharing

Penbroke may allow you to share a short quotation as text or as an image generated through the app.

Authorised quotation sharing is limited to:

  • Personal and non-commercial use
  • Short excerpts selected through Penbroke
  • The maximum character limit permitted by the app
  • Use of Penbroke’s authorised sharing feature
  • Inclusion of the book title, chapter, author, Penbroke attribution, or other information supplied by the sharing tool
  • Sharing that does not misrepresent the meaning or context of the work
  • Compliance with applicable copyright law

Penbroke currently limits an individual shared selection to a maximum of 600 characters.

The 600-character limit is a technical and contractual sharing limit. It does not mean that every use of 600 characters or fewer is automatically lawful, fair, or permitted in every context.

5. Required Attribution

When Penbroke automatically includes attribution with a shared quotation, you must not remove, conceal, crop out, alter, or misrepresent that attribution.

Attribution may include:

  • The book title
  • Chapter number or title
  • Author name
  • Penbroke name or branding
  • The Curving Point Ltd.
  • Other rights-holder information

You must not:

  • Present an author’s words as your own
  • Attribute a quotation to the wrong author or book
  • Alter a quotation in a way that changes its meaning without clearly identifying the alteration
  • Suggest that the author or The Curving Point Ltd. endorses you, your business, your organisation, or your views
  • Remove copyright or ownership notices

6. Prohibited Sharing

You may not:

  • Share an entire chapter
  • Share a substantial portion of a book
  • Share consecutive excerpts that collectively reproduce a substantial portion of a work
  • Repeatedly share excerpts in a manner that substitutes for reading or purchasing the original work
  • Copy chapter text manually to evade Penbroke’s sharing limit
  • Use screenshots, screen recordings, optical character recognition, transcription, automation, scraping, or other methods to bypass sharing restrictions
  • Upload Penbroke books or chapters to another app, website, cloud drive, forum, social network, or file-sharing service
  • Create or distribute PDF, EPUB, audiobook, video, database, or other reproductions of Penbroke content
  • Sell, license, rent, or commercially distribute quotations or quote images
  • Print Penbroke content on merchandise
  • Include Penbroke content in paid courses, newsletters, books, advertising, or commercial publications without written permission
  • Use Penbroke content to train, develop, test, or improve an artificial-intelligence or machine-learning system without written permission
  • Remove digital protections, watermarks, metadata, attribution, or access controls
  • Assist another person in carrying out any prohibited use

7. Social Media Sharing

You may use Penbroke’s authorised sharing tools to post short quotations to personal social-media accounts, provided that:

  • The post is non-commercial
  • Required attribution remains visible
  • The quotation remains within Penbroke’s sharing limit
  • The post does not reproduce a substantial part of the work
  • The quotation is not presented misleadingly
  • The post does not violate the rights of another person
  • The platform permits the content

Permission to share a short quotation does not give a social-media platform, page owner, business, or other party permission to reproduce or commercially exploit the underlying work.

8. Commercial and Organisational Use

Written permission is required before using Penbroke content for:

  • Advertising
  • Sponsored posts
  • Commercial social-media accounts
  • Business marketing
  • Church, school, workplace, or organisational publications
  • Training materials
  • Paid courses or workshops
  • Fundraising campaigns
  • Merchandise
  • Printed programmes
  • Newsletters with paid circulation
  • Podcasts, videos, broadcasts, or public performances
  • Anthologies or other publications
  • Large-scale distribution
  • Any use intended to generate revenue or promote a commercial activity

A church, school, book club, or other organisation may discuss a Penbroke book without permission, but reproducing or distributing protected content beyond a short quotation may require written authorisation.

Requests may be sent to info@thecurvingpoint.com.

9. Fair Use and Other Legal Exceptions

Copyright law may permit certain limited uses without permission, such as some uses for criticism, commentary, news reporting, teaching, scholarship, or research.

Whether a particular use qualifies for an exception depends on the facts, the purpose, the amount used, the nature of the work, the effect on the market, and the applicable law.

Penbroke’s sharing features and character limit do not:

  • Provide legal advice
  • Determine whether a use qualifies as fair use
  • Expand any copyright exception
  • Guarantee that a particular use is lawful
  • Replace the need to obtain permission when permission is required

You are responsible for determining whether your intended use is permitted by law.

10. Book Covers, Artwork, and Images

Book covers, illustrations, photographs, quote-card designs, logos, and promotional graphics may be separately protected by copyright, trademark, contractual rights, or rights of publicity.

Unless Penbroke expressly provides a sharing function for an image, you may not:

  • Download or extract it
  • Remove branding or attribution
  • Edit it for redistribution
  • Use it as a logo or profile image
  • Print it on merchandise
  • Use it in advertising
  • Sell or license it
  • Present it as your own work
  • create derivative designs based substantially on it

Sharing a screenshot of the Penbroke interface does not grant permission to reproduce the underlying book text, artwork, or branding beyond what is lawfully shown.

11. Penbroke Name and Branding

The names Penbroke and The Curving Point, together with their logos, icons, designs, slogans, and associated branding, may be protected by trademark, copyright, and other laws.

You may not use Penbroke branding in a way that:

  • Suggests an official partnership or endorsement
  • Creates confusion about the source of a product or service
  • Impersonates Penbroke or The Curving Point Ltd.
  • Is used as part of another application, business, website, product, or service name
  • Is misleading, defamatory, or unlawful
  • Alters or imitates the branding for commercial purposes

Accurate, non-misleading references to Penbroke for commentary, reviews, or discussion may be permitted by applicable law.

12. User-Created Community Content

You retain ownership of original community content that you create, such as your responses, comments, replies, and questions.

By posting community content, you grant The Curving Point Ltd. the licence described in the Penbroke Terms of Use to host, display, format, moderate, store, and otherwise process that content as necessary to operate Penbroke.

You must not post content that:

  • You copied without permission
  • Belongs to another author, artist, photographer, publisher, or user
  • Contains substantial portions of a copyrighted work
  • Was obtained through piracy or unauthorised distribution
  • Removes or falsifies attribution
  • Violates a confidentiality agreement
  • Infringes copyright, trademark, privacy, publicity, or other rights

Posting a source or author’s name does not by itself make unauthorised copying lawful.

13. Private Notes and Journal Entries

Highlights, notes, and journal entries designated as private are intended for your personal use.

You may include brief quotations where permitted by Penbroke’s features, but you must not use private-note tools to:

  • Store unauthorised copies of full chapters
  • Reconstruct a book outside Penbroke
  • Create a substitute copy of a protected work
  • Circumvent copying or sharing limits
  • Collect content for redistribution

Your original reflections remain yours, subject to the Penbroke Terms of Use and Privacy Policy.

14. Copyright Complaints

A copyright owner or authorised representative may report material believed to infringe copyright by emailing:

info@thecurvingpoint.com

A copyright complaint should include:

  • The complainant’s full name
  • Contact information
  • Identification of the copyrighted work
  • Identification of the allegedly infringing material
  • Information reasonably sufficient for us to locate the material
  • An explanation of why the use is believed to be unauthorised
  • A statement that the complaint is made in good faith
  • A statement that the information provided is accurate
  • Confirmation that the complainant owns the rights or is authorised to act for the owner
  • An electronic or physical signature

Incomplete notices may delay our ability to review a complaint.

15. Review and Removal of Reported Material

After receiving a copyright complaint, Penbroke may:

  • Request additional information
  • Temporarily restrict access to the disputed material
  • Remove the material
  • Notify the user who posted it
  • Preserve relevant records
  • Restore the material where appropriate
  • Restrict or terminate accounts involved in repeated infringement
  • Refer the matter to a service provider, legal adviser, or appropriate authority

Removal of material does not necessarily constitute an admission that infringement occurred.

We may reject complaints that are incomplete, fraudulent, abusive, or clearly unrelated to copyright.

16. Responses to Copyright Complaints

A user whose content was removed may contact us if they believe the removal was mistaken or the use was authorised.

The response should include:

  • The user’s name and account email
  • Identification of the removed content
  • An explanation of why the content should be restored
  • Evidence of permission, ownership, licence, or another legal basis where applicable
  • Confirmation that the information supplied is accurate

Submitting a response does not guarantee restoration.

We may decline to restore disputed material where ownership or permission remains unclear or where restoration could create legal, safety, or operational risk.

17. Repeat Infringement

Penbroke may warn, restrict, suspend, or terminate users who repeatedly infringe copyright or repeatedly violate this Policy.

We may consider:

  • The number of complaints
  • The seriousness of the conduct
  • Whether the user received prior warnings
  • Whether the user attempted to evade restrictions
  • Whether complaints appear valid and properly supported
  • Whether the conduct was deliberate
  • Any relevant legal obligations

Serious or deliberate infringement may result in immediate account action.

18. Misuse of the Complaint Process

Do not submit a copyright complaint that you know is false, misleading, retaliatory, or fraudulent.

Misuse may result in:

  • Rejection of the complaint
  • Removal of reporting privileges
  • Account restrictions
  • Account termination
  • Legal consequences where applicable

Copyright reporting tools should not be used merely to remove criticism, disagreement, unfavourable reviews, or content that does not infringe your rights.

19. Changes to This Policy

We may update this Copyright and Sharing Policy when Penbroke’s features, sharing tools, content licences, or legal obligations change.

The updated version will be posted with a revised effective date.

Material changes may also be communicated through Penbroke, the website, email, or another appropriate method.
